In this New York Post article, Nicholas Joseph Gutierrez withdrew his guilty plea after a Los Angeles judge rejected a probation-only arrangement and said she would require jail time for the crash that killed a sheriff’s recruit and injured many others.

  • Gutierrez, 25, had pleaded guilty to vehicular manslaughter with gross negligence and nine counts of reckless driving causing injury in connection with a 2022 wrong-way crash involving Los Angeles County sheriff’s recruits.
  • The plea deal reportedly would have suspended an eight-year prison sentence and placed him on probation for five years instead of sending him to jail.
  • Los Angeles County Superior Court Judge Laura Walton rejected the no-jail arrangement after hearing emotional testimony from victims and families.
  • Walton said she would accept the plea only if Gutierrez served one year in county jail.
  • Gutierrez’s attorneys withdrew the plea, meaning the case is now expected to proceed toward trial.
  • The crash happened when Gutierrez’s SUV veered into a group of sheriff’s recruits during a morning training run, injuring 25 people, including 10 seriously.
  • Recruit Alejandro Martinez-Inzunza died eight months later from injuries sustained in the crash.
  • Gutierrez previously claimed he had fallen asleep at the wheel, while his attorney now argues he may have suffered from an undiagnosed neurological condition or seizure disorder.
  • Former Los Angeles County Sheriff Alex Villanueva criticized the original plea deal as an insult to the victims and families.
  • Gutierrez is scheduled for a pretrial hearing on August 26.
