State Backs Down From Agenda to Violate Lawyers’ 1st Amendment Rights

In this WorldNetDaily article, Bob Unruh reports that Colorado has backed away from a rule that would have required private attorneys accessing the state court e-filing system to certify they would not assist federal immigration enforcement.

  • The controversy centered on a Colorado requirement that lawyers pledge, under penalty of perjury, not to use or share certain information from state court systems for immigration enforcement purposes.
  • Attorney Ian Speir of Colorado Springs challenged the policy after encountering the certification requirement while trying to represent a client.
  • The Foundation for Individual Rights and Expression said it was prepared to file a First Amendment lawsuit on Speir’s behalf if Colorado did not repeal or clarify the rule.
  • Colorado Gov. Jared Polis signed legislation clarifying that the state’s restrictions on sharing information with federal immigration officials do not apply to private attorneys accessing the electronic filing system for state courts.
  • Speir argued that private attorneys work for their clients, not the government, and said Colorado was backing down from a First Amendment fight it was unlikely to win.
  • FIRE attorney Greg Greubel said the government cannot condition an attorney’s access to courts on a promise not to use information for a lawful purpose disfavored by the state.
  • The article notes that Colorado had previously adopted rules restricting third-party sharing of state-managed records with federal immigration authorities, then expanded those rules to include legislative and judicial branches.
  • FIRE warned that the policy set a dangerous precedent, arguing that if blue states could restrict cooperation with immigration enforcement, red states could attempt similar restrictions involving federal environmental or labor enforcement.
