Queens resident Charles Foehner, a 67-year-old retired doorman, pleaded guilty Thursday to criminal possession of a weapon after he shot and killed a man attempting to rob him at gunpoint outside his Kew Gardens home. Under the plea deal, Foehner faces four years in prison, with sentencing set for January 14.
The shooting took place around 2 a.m. in a driveway near 82nd Avenue and Queens Boulevard, where Cody Gonzalez, the aggressor with at least 15 prior arrests dating back to 2004 and a history of mental illness, charged at Foehner while wielding what appeared to be a knife—later identified as a pen. Security footage captured Gonzalez lunging forward even after Foehner drew his unlicensed revolver in self-defense. Foehner told police he carried the gun to protect himself amid rising crime in the city.
Queens District Attorney Melinda Katz chose not to pursue manslaughter charges, acknowledging Foehner’s self-defense claim. But prosecutors moved forward on weapons possession after discovering additional unlicensed firearms in his home, including handguns, revolvers, and rifles. Foehner could have faced up to 25 years if convicted at trial on the full slate of gun charges.
Judge Toni Cimino allowed Foehner to remain free until sentencing, overruling the DA’s push to remand him to Rikers Island over the holidays. This decision lets Foehner spend Christmas with his wife before beginning his term.
Foehner’s attorney, Thomas Kenniff—who recently secured an acquittal for Marine veteran Daniel Penny in a high-profile subway chokehold case—defended his client fiercely.
“If this was a state and a city that had its affairs in order, Mr. Foehner would be getting a plaque, not a prison sentence,” Kenniff said. He blamed New York City’s strict gun permitting process for putting law-abiding citizens like Foehner in jeopardy while failing to curb violence from repeat offenders.
Kenniff added, “Lawmakers in New York City and Albany have repeatedly frustrated the rights of law abiding Americans, New Yorkers, that possess firearms.” He continued, “If we respected people’s constitutional right, and provided practical means for citizens to exercise that right, Mr. Foehner would not be in the position he is in today.”
The case spotlights how New York’s gun laws, among the nation’s toughest, often leave everyday people vulnerable to predators while punishing those who arm themselves without navigating the bureaucratic maze for permits. Gonzalez’s extensive rap sheet, including multiple arrests, raises questions about why such individuals roam free to prey on seniors in the dead of night. Meanwhile, Foehner, with no prior criminal record, now heads to prison for standing his ground.

Critics argue this outcome exemplifies a system that prioritizes control over personal safety, especially in a city where violent crime has surged in recent years, fueled by bail reforms and lenient prosecutions. Powerful interests in Albany benefit from keeping citizens disarmed and dependent, while the streets grow more dangerous for the average New Yorker.
And it’s only going to get worse under Mayor Zohran Mamdani.




We have a right to protect ourselfs with a firearm. Why is it better to have the victim always murdered? Any state with restrictive gun laws have the most crime. We need law abiding civilians to be able to carry a firearm

Dear Mr. Fochner congratulations in defending yourself against a deranged criminal and putting to rest his criminal abusive and dangerous life…neutralizing him has probably saved the lives of others that would have become just a statistical number in the deranged state of New York. Once you become a free man again please consider moving to Arizona…we have blue skies over 300 days a year…three climatic regions ( Sonoran Desert-Mexican Highlands-Colorado Plateau ) so you can enjoy an abundant life in the weather and topography that you like best…and best of all…we observe the ‘Right’ to own guns and defend yourself against potential risks of personal injury or death from dangerous criminal attack.
No Arizona is not perfect…we have too many Marxist Democrats and new arrivals from countries that refuse to assimilate into our culture and actually hate America seemly continually trying their best to ‘milk the system’ for free everything and the spit into the face of Arizona Taxpayer every chance they get…so don’t be surprised to find some of the same double standards of justice like there is in New York…but common sense prevails more often than not…
I am very happy that gentleman exercised his 2nd Amendment right and persuaded the criminal to take the room-temperature challenge.
However, I can not have sympathy for him regarding the arrest and charges. He has chosen to continue living in a tyrannical state instead of the several states that are proud to protect the individual’s God-given right to liberty and self-defense.
Perhaps this will be the straw that breaks New York’s obviously UNCOSTITUTIONAL gun laws. The US SUPREME COURT would overturn this case in a heartbeat if the citizen is convicted by a jury.
I thought that these gun laws had been struck down by the SCOTUS. When the 2nd Amendment was adoppted were there permits issue for guns? Where is the historical record?
God bless you, Mr. Fehner. You have a right as an American to own all those firearms and as many as you like. Now you live in NewYorkisstan under an even less tolerable regime. Get out while you still can. Texas is the ideal state to live in. Yeah we’re turning into a desert, but we have air conditioning everywhere. The wets are being removed daily and few are still coming in. If you and Mrs. Fehner need a place to retire, based on what you are paying in NYC, you could live well here. Said a prayer for you both.
Bob…I have many friends in Texas…it was once my first choice to move there from Ohio over 60 years ago…however I had a good job offer in Phoenix and took it instead…Texas has always had a special place in my heart…until now…Islam is taking over Texas and it is the elephant in the room and no one wants to talk about it…if let unchecked Islam will ‘rule’ Texas just like several other locations of influence…
New York failed. I should NEVER read that someone has had more than 9 previous arrests as they have proven they are unable to live in a civilized society. They should have been in prison for the rest of their life. Whatever happened to 3 strikes? By failing to put this career criminal away, they caused this to happen. People wouldn’t need to be armed if the crime wasn’t so bad.

I would never live in a place that thinks they (government) are allowed to make law contrary to the natural law of self-defense, it is human nature. We the people are supposed to be the lawmakers. Well, while he serves his time, maybe he should read a pocket constitution. I feel no sorrow for him. …sorry, but 99% of ALL Police Officers are indeed on ‘our side’…I was a city police officer and then a AZDPS Uniform Division ( Highway Patrolman ) from the 1960’s-80…had to deal with the fallout from the Watts Riots…Simioiz Liberty Army (SLA)…Chicago ‘7’…Black Panthers…among the most notable…if it wasn’t for the ‘public support’, my job would have been impossible to accomplish…We were sworn ‘Peace Officers’ who laid down our own safety (and sometimes our own lives) to maintain a peaceful and hopefully tranquil life for the common everyday citizen…at times it was difficult and somewhat dangerous but well worth it when we could see the ‘fruits of our labor’….a safe and prosperous populous…I do take personal insults just as well as I did back 65 years ago…people never really change as a whole…there are the ‘doers’ ( work for a living )…the takers ( criminal minded )…and the ‘victims’ ( easy prey for the takers)…same today as it was 6 decades ago…the Police are the ‘Thin Blue Line’ that separate the good from the bad…try it yourself…you might enjoy the job and it is never boring or mundane…Good Luck !
I don’t get why his house was searched? The court decided self defense prevailed in the incident and did the court then feel justified in doing a search? Based on what? 4th Amendment violation here?
